EXPORT COMPLIANCE POLICY

BYOSwerx is committed to full compliance with all applicable U.S. export control laws and regulations, including the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce, Bureau of Industry and Security.

PRODUCT CLASSIFICATION

Byos cybersecurity products distributed by BYOSwerx are classified under the Export Control Classification Number (ECCN) 5A002 and 5D002. These products incorporate encryption and information security features subject to U.S. export controls.

AUTHORIZED DESTINATIONS

BYOSwerx may export BYOS products to most destinations worldwide under License Exception ENC. However, we cannot export to the following destinations without special authorization:

  • Cuba
  • Iran
  • North Korea
  • Syria
  • Crimea region of Ukraine

Additionally, we cannot provide products or services to individuals or entities on U.S. government restricted parties lists, including the Entity List, Denied Persons List, and Specially Designated Nationals List.

CUSTOMER RESPONSIBILITIES

Customers who purchase Byos products from BYOSwerx agree:

  • Not to export, re-export, or transfer products to prohibited destinations without proper authorization
  • Not to provide products to restricted end-users
  • To comply with applicable import regulations in their country
  • To notify BYOSwerx if they become subject to export restrictions

RESTRICTED END-USES

Byos products may not be used in connection with:

  • Development, production, or use of chemical, biological, or nuclear 

  weapons or missiles

  • Any activity prohibited under U.S. export controls or sanctions programs
